OVERVIEW

Welcome to Joydotz. The Joydotz store and brand are operated by Swedish Falls, LLC. In these Terms of Service, the terms “Joydotz,” “we,” “us,” and “our” refer to Swedish Falls, LLC.

Joydotz operates this website and online store, including all related information, content, features, tools, products, and services provided as part of your shopping experience (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with all policies referenced in them, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information regarding purchases, recurring subscriptions, returns, disclaimers, limitations of liability, and other legal rights.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not access or use the Services.

SECTION 1 — ELIGIBILITY AND ACCESS

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence.

If you permit a minor dependent to access or use the Services through a device, account, or payment method that you own or control, you are responsible for that use to the extent permitted by applicable law.

You may use the Services only for lawful personal or household purposes and in accordance with these Terms.

SECTION 2 — CUSTOMER INFORMATION AND ACCOUNTS

To browse our store, place an order, purchase a subscription, or use certain features, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address.

You represent that all information you provide is accurate, current, complete, and authorized for your use. You agree to update your information when necessary so that we can process your orders and contact you regarding your purchases.

Certain account or subscription-management features may require you to verify the email address used for your order or sign in through Shop or another Shopify-supported authentication method.

You are responsible for maintaining the security of your account access and for activity conducted through your account. You may not sell, transfer, assign, or license your customer account to another person.

SECTION 3 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to display and describe our products accurately. However, product colors, finishes, shapes, packaging, scale, and appearance may vary slightly because of lighting, photography, screen settings, manufacturing tolerances, or other factors.

Product images may include styling props, enlarged details, digital renderings, or packaging examples that are not included with the product unless expressly stated.

Certain Joydotz products may include assorted, surprise, limited, or hidden designs. Where a product is identified as assorted, random, surprise, or containing a possible hidden design, a specific design or variant is not guaranteed unless the product page expressly provides a selection option.

Product descriptions, packaging, prices, promotions, and availability may be changed without notice. We may discontinue products or limit available quantities at any time.

We do not guarantee that a product’s appearance will exactly match its depiction on your screen or that every product will meet subjective expectations.

SECTION 4 — ORDERS AND ACCEPTANCE

When you submit an order, you are making an offer to purchase products from Joydotz.

An order confirmation acknowledges that we received your order but does not necessarily mean that the order has been accepted. We may accept, decline, limit, or cancel an order when reasonably necessary, including because of:

Product or inventory availability;
Payment authorization problems;
Pricing, promotional, tax, or listing errors;
Suspected fraud or unauthorized activity;
Shipping restrictions;
Unusually large quantities;
Suspected commercial resale; or
A violation of these Terms.

If we decline or cancel an order after payment has been collected, we will issue the applicable refund to the original payment method.

Please review your products, quantities, shipping address, billing information, and selected purchase option carefully before submitting an order.

Eligible unfulfilled orders may be canceled within 24 hours after the order is placed. Cancellation is not guaranteed once an order has entered processing. Orders that have been fulfilled or shipped cannot be canceled and are instead subject to our Return and Refund Policy.

You represent that products purchased through the Services are intended for lawful personal or household use and not for unauthorized commercial resale or export.

SECTION 5 — PRICES, DISCOUNTS, AND BILLING

Unless otherwise indicated, prices displayed on the Joydotz website are stated in United States dollars.

Prices, subscription savings, discounts, promotional codes, and special offers may change without notice. The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious errors.

Unless expressly stated otherwise, displayed product prices do not include applicable sales taxes or shipping charges.

Shipping charges and free-shipping eligibility are determined in accordance with our Shipping Policy and the shipping options available for the applicable order.

Regular orders with a merchandise subtotal of $30 or more before discounts and taxes qualify for free standard shipping within our eligible shipping area. Orders containing The Dreamy Dotz Trio qualify for free standard shipping regardless of merchandise subtotal. Other applicable shipping charges are displayed at checkout before the order is submitted.

Promotional offers may be subject to separate conditions, expiration dates, product exclusions, minimum purchase requirements, customer-eligibility requirements, purchase-type restrictions, usage limits, and restrictions on combining discounts.

Certain promotional discounts may apply only to specified products or purchase types. Eligibility and exclusions shown with an offer or at checkout form part of the applicable promotional terms.

If separate promotional terms conflict with these Terms, the promotional terms control for that promotion.

You agree to provide accurate and complete billing and payment information. By submitting an order, you authorize Joydotz and its payment service providers to charge the selected payment method for the total amount displayed at checkout.

We may correct pricing, discount, tax, inventory, or shipping errors. If an affected order must be canceled after payment has been collected, the applicable amount will be refunded to the original payment method.

SECTION 6 — SHIPPING AND DELIVERY

Joydotz currently ships only to eligible addresses within the contiguous United States, including Washington, D.C., as further described in our Shipping Policy.

We do not currently ship to Alaska, Hawaii, Puerto Rico, U.S. territories, APO/FPO/DPO addresses, or international destinations.

Shipping rates, free-shipping thresholds, available shipping methods, and estimated delivery periods are displayed at checkout or described in our Shipping Policy.

All processing and delivery periods are estimates and are not guaranteed. Delivery may be affected by carriers, weather, holidays, service interruptions, incorrect customer information, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate shipping address. Please contact us immediately if you discover an error. We cannot guarantee that an address can be changed after an order enters processing.

Title and risk of loss pass to the customer when the order is delivered to the shipping address provided at checkout, except where applicable law requires otherwise.

If an order arrives damaged, defective, incomplete, or incorrect, contact us at contact@joydotz.us in accordance with our Return and Refund Policy.

SECTION 7 — RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, damaged-item claims, and order cancellations are governed by our Return and Refund Policy.

Eligible return requests must generally be submitted within 14 days after delivery. Products must be unused, unopened, in their original sealed packaging, and otherwise satisfy the requirements of our Return and Refund Policy.

For hygiene and product-safety reasons, opened, used, unsealed, or customer-damaged personal-care products are not eligible for a standard change-of-mind return unless the product arrived damaged, defective, or incorrect.

The Dreamy Dotz Trio is sold as a set containing one box each of Softwing Butterfly, Daydream Cloud, and Blush Flower.

For a standard change-of-mind return, the complete Trio must be returned together, and all included boxes must satisfy the applicable return requirements. We do not accept partial change-of-mind returns of individual boxes from The Dreamy Dotz Trio.

Damaged, defective, missing, or incorrect items are handled in accordance with our Return and Refund Policy.

Approved refunds are based on the amount actually paid for the eligible returned product after applicable discounts or promotions. Discounts, promotional credits, and promotional value are not separately refundable.

For standard returns, the customer is responsible for return shipping costs. Original shipping charges are generally non-refundable. We do not charge a restocking fee.

We do not currently offer direct exchanges. When an eligible return is approved, the customer may receive a refund and place a separate new order.

If there is a conflict between this summary and our Return and Refund Policy, the Return and Refund Policy controls.

SECTION 8 — SUBSCRIPTIONS AND RECURRING PURCHASES

Certain eligible Joydotz products may be offered as recurring subscriptions.

Before submitting a subscription order, you will be shown the applicable product, price, discount, delivery frequency, shipping charges, billing frequency, and automatic-renewal terms.

By purchasing a subscription, you affirmatively authorize Joydotz and its payment service providers to charge your selected payment method automatically for each recurring order until the subscription is canceled.

Customers who enroll in a subscription online may cancel future recurring orders through the online subscription-management features made available through their customer account or applicable subscription-management link.

You may also contact contact@joydotz.us for assistance with your subscription.

Depending on the subscription options available, customers may also be able to change certain subscription details, skip an upcoming order, pause a subscription, or resume a paused subscription.

Canceling a subscription stops future recurring orders and charges. It does not automatically cancel or refund an order that has already been created, processed, charged, fulfilled, or shipped.

Orders already generated through a subscription are subject to our Return and Refund Policy.

Any eligible refund relating to a subscription order will be based on the amount actually paid for that order after the applicable subscription discount or other eligible adjustment.

Subscription management and future cancellations are also governed by our Purchase Options Cancellation Policy.

If a recurring payment fails, we may retry the payment and may skip, pause, or cancel the affected subscription as permitted by the applicable subscription settings and law.

We may change subscription prices or terms prospectively. When required by applicable law, we will provide advance notice of material changes, renewal information, reminders, cancellation information, or other required notices.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Joydotz is operated by Swedish Falls, LLC and is powered by Shopify, which provides the ecommerce infrastructure used to offer the Services.

Any purchase from Joydotz is made directly between you and Swedish Falls, LLC. Shopify is not the seller of Joydotz products and is not responsible for Joydotz product fulfillment, customer service, product claims, returns, or administration of our store policies.

To the fullest extent permitted by applicable law, Shopify and its affiliates are not liable for claims arising solely from the sale, fulfillment, delivery, or use of products purchased directly from Joydotz.

SECTION 10 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify also collects and processes certain personal information to provide, secure, and improve its platform and related services.

Information submitted through the Services may be transmitted to Shopify, payment providers, shipping providers, analytics providers, marketing providers, and other service providers that assist us in operating the store. Some service providers may process information in countries other than the country where you reside.

Please review our Privacy Policy for information regarding the personal information we collect, how it is used and disclosed, and the choices or rights that may be available to you.

SECTION 11 — INTELLECTUAL PROPERTY

The Services and their content, including text, photographs, graphics, product images, videos, designs, logos, icons, page layouts, branding, and other materials, are owned by or licensed to Swedish Falls, LLC or the applicable rights holder and are protected by intellectual-property laws.

Joydotz names, logos, designs, product names, packaging, slogans, visual elements, and related brand identifiers may constitute trademarks, trade dress, copyrighted material, or other proprietary rights of Swedish Falls, LLC or its licensors.

These Terms grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal and non-commercial purposes.

Without prior written permission, you may not reproduce, copy, modify, distribute, publish, display, transmit, sell, license, create derivative works from, or commercially exploit any portion of the Services or their content.

No provision of these Terms transfers ownership of any intellectual-property rights to you.

SECTION 12 — REVIEWS, FEEDBACK, AND USER CONTENT

If you submit a review, photograph, video, comment, idea, suggestion, or other content to Joydotz, you represent that:

You own the content or have permission to submit it;
The content is accurate based on your genuine experience;
The content does not violate another person’s intellectual-property, privacy, publicity, or other rights;
Any compensation, discount, gift, free product, or other incentive connected with the submission has been properly disclosed; and
The content is not unlawful, deceptive, defamatory, abusive, obscene, threatening, or malicious.

You grant Swedish Falls, LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display submitted content for operating, improving, and promoting Joydotz and the Services.

We are not required to keep feedback confidential, pay compensation for unsolicited feedback, or respond to every submission.

We may monitor, refuse, edit, or remove submitted content when we reasonably believe it violates these Terms, applicable law, or the rights of another party.

SECTION 13 — THIRD-PARTY SERVICES AND LINKS

The Services may include links, integrations, payment tools, account tools, social-media features, or other services operated by third parties.

We do not control third-party services and do not guarantee their accuracy, availability, security, or performance.

Your use of third-party services may be governed by separate terms and privacy policies. You are responsible for reviewing those terms before using the third-party service.

To the fullest extent permitted by law, Joydotz is not responsible for harm or loss caused solely by a third-party website, tool, service, product, or transaction outside our control.

SECTION 14 — PROHIBITED USES

You may not use the Services:

For an unlawful, fraudulent, deceptive, or malicious purpose;
To violate any applicable law, regulation, or legal right;
To infringe intellectual-property, privacy, publicity, or other rights;
To harass, threaten, abuse, impersonate, or harm another person;
To submit false or misleading information;
To transmit viruses, malware, or harmful code;
To interfere with the security or operation of the Services;
To gain unauthorized access to an account, system, or network;
To collect or track another person’s personal information without authorization;
To send spam, phishing messages, or unauthorized solicitations;
To circumvent purchasing restrictions, security controls, or fraud-prevention measures;
To scrape, copy, extract, or commercially exploit content without permission; or
To purchase products for unauthorized commercial resale or export.

We may restrict or terminate access to the Services when we reasonably believe these Terms have been violated.

SECTION 15 — ERRORS, INACCURACIES, AND AVAILABILITY

The Services may occasionally contain errors, inaccuracies, or omissions relating to product descriptions, images, prices, promotions, shipping charges, inventory, transit times, or availability.

We reserve the right to correct errors, update information, change or discontinue products, and cancel affected orders, including after an order has been submitted.

We are not obligated to update every item of information except where required by applicable law.

SECTION 16 — PRODUCT USE AND GENERAL INFORMATION

Joydotz products should be used only as directed on the applicable packaging and product page.

Joydotz decorative hydrocolloid face patches are personal-care products. Information presented through the Services is provided for general informational purposes and is not medical advice.

Statements made through the Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Review the applicable product information and instructions before use.

If irritation, redness, discomfort, or another adverse reaction occurs, discontinue use. Seek advice from a qualified healthcare professional regarding medical concerns or persistent skin conditions.

You are responsible for reviewing product instructions and determining whether a product is appropriate for your intended personal use.

SECTION 17 — DISCLAIMER OF WARRANTIES

We make reasonable efforts to keep the Services accurate, secure, and available, but we do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

Except for warranties expressly provided by Joydotz or warranties, consumer protections, or other rights imposed by applicable law, we make no additional warranties regarding the operation or availability of the Services.

Nothing in these Terms excludes, restricts, or limits any statutory warranty, consumer protection, or other right or remedy that cannot legally be waived, restricted, or excluded.

SECTION 18 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Swedish Falls, LLC, Joydotz, Shopify, and their respective affiliates, officers, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the Services or products purchased through the Services.

This includes, to the extent permitted by law, lost profits, lost revenue, lost savings, loss of data, loss of goodwill, business interruption, or replacement costs.

To the fullest extent permitted by applicable law, the aggregate liability of Swedish Falls, LLC arising from or related to a particular order will not exceed the amount paid to Joydotz for that order.

These limitations do not apply to liability that cannot legally be excluded or limited, including liability arising from fraud, willful misconduct, gross negligence, personal injury where limitation is prohibited, or any other matter for which applicable law does not permit limitation.

Nothing in these Terms limits any mandatory consumer right or remedy.

SECTION 19 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Swedish Falls, LLC, Joydotz, Shopify, and their respective affiliates, officers, employees, agents, contractors, service providers, and licensors from third-party claims, losses, damages, liabilities, and reasonable legal expenses arising from:

Your material violation of these Terms;
Your unlawful or unauthorized use of the Services;
Content you submit in violation of another person’s rights; or
Your violation of applicable law.

This obligation does not apply to the extent a claim results from the negligence, unlawful conduct, or breach of duty of the party seeking indemnification.

SECTION 20 — EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure to perform caused by events outside our reasonable control, including severe weather, natural disasters, fire, flood, epidemic, pandemic, war, civil unrest, labor disputes, government actions, customs delays, transportation interruptions, carrier failures, power failures, internet outages, cyberattacks, or supply-chain disruptions.

This section does not limit rights or remedies that cannot legally be excluded.

SECTION 21 — SUSPENSION AND TERMINATION

We may suspend, restrict, or terminate access to all or part of the Services when reasonably necessary to:

Protect customers, Joydotz, Shopify, or third parties;
Prevent fraud, abuse, unauthorized activity, or security threats;
Comply with law or a legal request; or
Address a material violation of these Terms.

Termination does not eliminate obligations or liabilities that arose before termination.

Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, payment obligations, disclaimers, liability, indemnification, governing law, and dispute-related rights.

SECTION 22 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 23 — WAIVER AND ENTIRE AGREEMENT

A failure by Joydotz to enforce a provision of these Terms does not waive the right to enforce it later.

These Terms and the policies incorporated into them constitute the entire agreement between you and Swedish Falls, LLC regarding your use of the Services and supersede prior communications concerning the same subject.

Our applicable policies include the Privacy Policy, Shipping Policy, Return and Refund Policy, and Purchase Options Cancellation Policy.

If a store policy expressly addresses a specific transaction and conflicts with a general provision of these Terms, the more specific store policy controls for that transaction, except where applicable law requires otherwise.

SECTION 24 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms as part of a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the Joydotz business, subject to applicable law.

SECTION 25 — GOVERNING LAW

These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles.

Nothing in this section deprives a consumer of mandatory protections available under the laws of the jurisdiction where the consumer resides.

SECTION 26 — CHANGES TO THESE TERMS

We may update these Terms from time to time by posting the revised version on this page and updating the effective date.

When required by applicable law, we will provide additional notice of material changes.

Changes apply prospectively from their effective date. Continued use of the Services after the effective date constitutes acceptance of the updated Terms to the extent permitted by applicable law.
